I fol­low a col­lab­o­ra­tive, prag­mat­ic and prac­ti­cal approach when draft­ing con­tracts, advis­ing on legal mat­ters and pro­vid­ing legal solu­tions that are tai­lored to each clients’ spe­cif­ic situation.

As a result of hav­ing run my own South African law prac­tice for more than 9 years, and hav­ing worked in Aus­tralia and South Africa, I bring a diver­si­fied skillset to the con­struc­tion work done by the Swaab Con­struc­tion, Prop­er­ty, Plan­ning and Projects team.

I have expe­ri­ence in advis­ing on project deliv­ery meth­ods, draft­ing and struc­tur­ing tem­plate suites of con­struc­tion con­tracts, nego­ti­at­ing upstream and down­stream con­struc­tion agree­ments, advis­ing on how to under­take gen­er­al con­struc­tion admin­is­tra­tion and sit­ting as a medi­a­tor in com­mer­cial and con­struc­tion disputes.

Australia:

  • GC-21 Contract and Design and Construct contract
  • preparation and amending of bespoke template agreements, including Minor Works Contracts, Minor Consultancy Contract for consistency within the contract, and amendments for compliance with the Australian Consumer Law and unfair contract terms
  • preparation of Access Deeds for adjoining land and advice in respect of development consent compliance requirements
  • preparation and amending various Australian Standards contracts

South Africa:

  • projects such as joint venture investments, chlorine and disinfection plant, shopping centre, hotel and convention centre, luxury homes, and fit-out works
  • clients such as independent consultants, architects, engineers, forensic auditors, development managers, and designers; principal / head builders and sub-contractors; land/building owners; and residential homeowners
