Strata disputes:
Acting in all jurisdictions in respect of strata disputes in the NSW Civil and Administrative Tribunal and Supreme Court of New South Wales including:
- making and defending claims for breach of duty to maintain and repair common property under section 106 of the Strata Schemes Management Act 2015 including associated claims for loss and damage
- making and defending claims for unauthorised works to common property
- making and defending claims for compulsory strata management under section 237 of the Act
- making or defending claims for unreasonable withholding of consent to by-laws
- by-law disputes, penalty notices and applications
- section 88K easement applications
Building Defects claims and construction including:
- advice as to applicability of Design and Building Practitioners Act and accompanying regulations to remedial works
- advice as to and preparation of building contracts and/or consultancy agreements in respect of remedial works
- making and defending claims for breaches of statutory warranty under the Home Building Act 1989 for building defects
- making and defending claims for breaches of statutory duty of care under Part 4 of the Design and Building Practitioners Act 2020
- making homeowners warranty insurance claims

Strata Renewal and Strata termination
- acting for owners corporations and/or developers in respect of collective sales or redevelopments of strata schemes under Part 10 of the Strata Schemes Development Act 2015
- acting for lot owners as dissenting owners under Part 10 of the Strata Schemes Development act 2015
- acting for lot owners as a collaborative group preparing owners collaborative agreements, memorandum of understanding, special conditions for agency agreements, call option deeds
- appearing in Land and Environment Court of NSW for Part 10 proceedings on behalf of all parties
- applications for termination of strata schemes under Part 9 of the Strata Schemes Development Act 2015
Design and Building Practitioners Act 2015
Advice in all areas of application of the Design and Building Practitioners Act 2015 including:
- application of the Act and regulations to your remedial building works
- whether your remedial building works require development approval
- engagement of appropriate practitioners
- as to the process and requirements for the NSW Planning Portal
- as to the Residential Apartment Buildings (Compliance and Enforcement) Act 2020
- as to the issuing of Building Works Rectification Orders by the Building Commission NSW
Strata Development:
- advice in relation to the structuring and configuration of mixed-use developments (commercial, retail and residential) including green field sites, brown field sites and expansion of current developments
- drafting section 88B instruments to accompany community title, stratum and strata plans of subdivision
- drafting documents to create easements and restrictions on use of land subsequent to the creation of a community title or strata title scheme
- drafting bespoke Community Management Statements and Strata Management Statements to reflect the place making desired of the developer
- drafting bespoke by-laws to reflect the place making desired of the developer
- advice in relation to limitations and options of the developer during the initial period.
