Pri­or to project commencement

Under­stand­ing your project is a vital step in the prepa­ra­tion of con­tract doc­u­men­ta­tion to ensure you have a smooth process dur­ing the works phase. Our team will:

• liaise with you to under­stand your project needs whether as a prin­ci­pal, con­trac­tor or superintendent
• assist you in ensur­ing you have the nec­es­sary sup­port and peo­ple for your project needs
• pre­pare con­tracts for ten­der appro­pri­ate for your project needs includ­ing amend­ing Aus­tralian Stan­dard Gen­er­al Con­di­tions (e.g. AS4000, AS4905, AS4902, AS4906, AS4122) and prepar­ing accom­pa­ny for­mal instru­ments of agree­ment or prepa­ra­tion of bespoke agreements
• assist­ing builders, devel­op­ers, con­sul­tants pre­pare suites of tem­plate con­tracts for ongo­ing use in their businesses
• liaise with project manager/​superintendent as to ten­der process
• pre­pare ear­ly works agreements
• pre­pare let­ters of intent/​conditional accep­tance of tender
• liaise with all par­ties to pre­pare final con­tract documents 
• pre­pare all nec­es­sary con­sul­tan­cy and/​or super­in­ten­dent agreements
• con­duct­ing appro­pri­ate licence and reg­is­tra­tion checks and com­pa­ny searches
• advise as to appro­pri­ate insur­ance cover

Dur­ing the project

If any needs or issues arise dur­ing the course of your project, we will be on hand to:

• assist you with inter­pre­ta­tion of con­tract terms
• par­tic­i­pate in dis­pute res­o­lu­tion to come up with non-liti­gious solutions
• pre­pare any nec­es­sary vari­a­tions of con­tract or addi­tion­al agreements
• assist in SOPA claims
• ter­mi­na­tion of con­tracts for seri­ous breaches

After project completion

After works are com­plete, we can assist in:

• tra­vers­ing final pay­ment claims
• advis­ing on the man­age­ment of defects dur­ing the defects lia­bil­i­ty period
• con­tract claims in case of a dispute
• com­mon law claims in cas­es of negligence 
• claims under the Design and Build­ing Prac­ti­tion­ers Act 2020 for breach of duty of care
• dis­pute resolution
• SOPA claims

Our spe­cialised team can pro­vide you with tar­get­ed advice for your reme­di­al project with full con­sid­er­a­tion of the Design and Build­ing Prac­ti­tion­ers Act 2020 (DBP Act) and accom­pa­ny­ing reg­u­la­tions including:

• advice as to appro­pri­ate form of con­tract for your reme­di­al res­i­den­tial build­ing works
• spe­cial­ist advice to own­ers cor­po­ra­tions and/​or build­ing, design prac­ti­tion­ers as to process and obligations
